Until recently, retention of introns in mature mRNAs has been regarded as a consequence of mis‐splicing. Intron‐retaining transcripts are thought to be non‐functional because they are readily degraded by nonsense‐mediated decay. However, recent advances in next‐generation sequencing technologies have enabled the detection of numerous transcripts that retain introns. As we review herein, intron‐retaining mRNAs play an essential conserved role in normal physiology and an emergent role in diverse diseases. Intron retention should no longer be overlooked as a key mechanism that (...) independently reduces gene expression in normal biology. BackgroundThe death of a loved one can trigger a range of responses, including painful thoughts and emotions, as well as positive changes, such as post-traumatic growth. To understand more about the relationship between these outcomes this study explored the co-occurrence of depression, anxiety and PTG among a group of bereaved Chinese adults.MethodsData were collected from 194 participants, who had lost a first-degree relative. Latent class analysis was used to analyze the data to identify subgroups of participants with shared symptom profiles.ResultsThree (...) classes were identified: a Growth class, a Depression/Anxiety/Growth class and a Depression/Anxiety class. Marital status, social support, close relationship with the deceased and witnessing the suffering of the deceased were identified as differential predictors of class membership.ConclusionThe findings contribute to our understanding of the potentially wide ranging impacts of bereavement and highlight the important role of stressor characteristics and support and in influencing impairment and positive outcomes. Cultural competence, a clinical skill to recognise patients' cultural and religious beliefs, is an integral element in patient‐centred medical practice. In the area of death and dying, physicians' understanding of patients' and families' values is essential for the delivery of culturally appropriate care. Dementia is a neurodegenerative condition marked by the decline of cognitive functions. When the condition progresses and deteriorates, patients with advanced dementia often have eating and swallowing problems and are at high risk of developing malnutrition. Enteral tube (...) feeding is a conventional means of providing artificial nutrition and hydration to meet nutritional needs, but its benefits to the frail population are limitedly shown in the clinical evidence. Forgoing tube feeding is ethically challenging when patients are mentally incompetent and in the absence of an advance directive. Unlike some developed countries, like the United States of America, death and dying is a sensitive issue or even a taboo in some cultures in developing countries that forgoing enteral tube feeding is clinically and ethically challenging, such as China and Malaysia. This article in three parts 1) discusses the clinical and ethical issues related to forgoing tube feeding among patients with advanced dementia, 2) describes how Hong Kong Chinese, North American, and Malaysian Islamic cultures respond differently in the decision‐making patterns of forgoing tube feeding for patients with advanced dementia, and 3) reiterates the clinical implications of cultural competence in end‐of‐life care. Social technology can improve the quality of older adults' social lives and mitigate negative mental and physical health outcomes associated with loneliness, but it should be designed collaboratively with this population. In this paper, we used participatory design methods to investigate how robots might be used as social facilitators for middle-aged and older adults in both the US and Japan. We conducted PD workshops in the US and Japan because both countries are concerned about the social isolation of these older (...) adults due to their rapidly aging populations. We developed a novel approach to participatory design of future technologies that spends 2/3 of the PD session asking participants about their own life experiences as a foundation. This grounds the conversation in reality, creates rapport among the participants, and engages them in creative critical thinking. Then, we build upon this foundation, pose an abstract topic, and ask participants to brainstorm on the topic based on their previous discussion. In both countries, participants were eager to actively discuss design ideas for socially facilitative robots and imagine how they might improve their social lives. US participants suggested design ideas for telepresence robots, social distancing robots, and social skills artificial intelligence programs, while Japanese participants suggested ideas for pet robots, robots for sharing experiences, and easy-to-operate instructor robots. Comparing these two countries, we found that US participants saw robots as tools to help facilitate their social connections, while Japanese participants envisioned robots to function as surrogate companions for their parents and distract them from loneliness when they were unavailable. With this paper, we contribute to the literature in two main ways, presenting: A novel approach to participatory design of future technologies that grounds participants in their everyday experience, and Results of the study indicating how middle-aged and older adults from the US and Japan wanted technologies to improve their social lives. Although we conducted the workshops during the COVID-19 pandemic, many findings generalized to other situations related to social isolation, such as older adults living alone. (shrink)

Structured interviews were held with 149 registered nurses in seven countries in America, Asia, Australia and Europe concerning the feeding of severely demented patients who do not accept food. The most common reasons for nurses being willing to change their decision to feed or not to feed were an order from the medical head, a request from the patient's husband and/or the staff meeting. There was a connection between the willingness to feed and the ranking of ethical principles. Nurses who (...) were most prone to feed the patient most often gave a high rank to the ethical principle of sanctity of life, while those who primarily chose not to feed the patient gave a high rank to the ethical principle of autonomy. All nurses stressed the ethical principle of beneficence. Des interviews structurés ont eu lieu avec 149 infirmiers/ères dans sept pays en Amérique, Asie, Australie et Europe concernant l'alimentation des malades gravement dément qui refusent de manger. La raison la plus générale pour des infirmiers/ères d'être prêt à changer leures décisions de donner à manger ou non sont: un ordre du médecin, la demande du mari de la malade ou de la réunion du personnel. Il y avait un lien entre la volonté de nourir et le rang des principes éthiques. Les infirmiers/ères les plus enclins de nourir la malade le plus souvent donnaient un rang supérieur au principe éthique de la sainteté de vie, pendant que ceux et celles qui choisissaient de ne pas nourrir la malade donnaient un rang supérieur au principe éthique de l'autonomie. Tous insistaient sur l'importance du principe éthique de la bienfaisance. Konstruktive Interviews wurden mit 149 ausgebildeten Krankenschwestern und Pfleger in sieben Ländern in Amerika, Asien, Australien und Europa gehalten über die Ernährung von schwer von Dementia praecox leidenden Patienten, die das Essen verweigern. Die gewöhnlichsten Gründe des Pflegepersonals für die Bereitwilligkeit, ihre Entscheidung, zu ernähren oder nicht, zu ändern, waren Anordnungen vom medizinischen Chef, Anfragen vom Ehemann der Patientin und/oder einer Personalsitzung. Es bestand ein Zusammenhang zwischen der Bereitwilligkeit zur Ernährung und dem Rang der ethischen Prinzipien. Die Pflegenden, die sich am meisten neigten, die Patientin zu ernähren, gaben dem ethischen Prinzip der Heiligkeit des Lebens einen hohen Rang, während die, die meistens vorzogen, die Patientin nicht zu ernähren, gaben dem ethischen Prinzip der Autonomie einen hohen Rang. Alle Pflegenden legten grossen Wert auf das ethische Prinzip der Wohltätigkeit. (shrink)

Dieser Aufsatz ist eine Besinnung auf den Begriff Individuum, wie dieser in der Biologie gebraucht wird, und er beabsichtigt, den Inhalt dieses Begriffes theoretisch zu begründen. Es ist aber unmöglich für die nähere Bestimmung des Begriffes Individuum von der etymologischen Bedeutung „unteilbar” auszugehen, weil die biologischen Individuen nicht immer unteilbar sind. Beim Suchen nach einem richtigen Untersuchungsverfahren wird zunächst dargelegt, wie diese Untersuchung wesentlich ein Teil der theoretischen Biologie, also der Wissenschaft, ist, wenn man auch von deutlichen Zusammenhängen mit der (...) Philosophie und dem spontanen Denken sprechen kann. Deshalb wird die Methode, nach der wir vorangehen müssen, die induktive Methode sein, weil diese in der Wissenschaft mit Recht hoch eingeschätzt wird.Bei den grossen Vertretern der verschiedenen Richtungen in der Biologie, beiHaeckel, von Bertalanffy, Driesch undBergson, werden in ihre Auffassungen über Individuum und Individualität derartige Übereinstimmungen festgestellt, dass darin nach den Gesetzen der Induktion die wesentlichen Momente des biologischen Individuumbegriffes erkannt werden können. Ausserdem stimmen diese Momente mit dem Inhalt des Begriffs zusammen, wie der sich aus dem spontanen Denken ergibt.Diese Momente sind: Subsistenz, Einheit und Totalität, Tendenz nach einem geschlossenen System und schliesslich die Unmöglichkeit einer erschöpfenden Definition. In dieser Reihenfolge werden sie kritisch erörtert, und daraufhin werden folgende biologische Begriffsbestimmungen vorgeschlagen : Individualität ist die Tendenz des einzelnen Organismus nach ungeteilter subsistenter Totalität. Etwas ist Individuum in dem Masse, wo diese Tendenz verwirklicht ist.Durch einige Beispiele aus dem System und der Ontogenie wird die Anwendung dieses dynamischen Begriffes erläutert.Dans cette étude nous avons soumis à un examen l'idée d'individu, telle qu'elle est d'un usage courant en biologie. Nous avons cherché à fonder la théorie du contenu de cette idée. Pour en donner une définition plus exacte, nous ne pouvons pas prendre pour point de départ le sens étymologique d'„indivisible”, puisque les individus biologiques ne le sont pas toujours. En essayant d'abord d'établir la vraie méthode de notre recherche, nous avons expliqué que celle-ci est une branche de la biologie théorique, par conséquent de la science positive, bien qu'il y ait des rapports avec la philosophie et avec la simple pensée spontanée. Il nous faudra donc procéder d'après la méthode qui est surtout demandée par les sciences exactes, à savoir la méthode inductive.Chez les grands représentants des différents courants de la pensée en biologie, notamment chezHaeckel, von Bertalanffy, Driesch etBergson, nous rencontrons dans leurs conceptions sur l'individu et sur l'individualité des correspondances tellement frappantes que nous sommes autorisé à y voir, d'après les lois mêmes de l'induction, les éléments essentiels de l'idée d'individu biologique. Ces éléments s'accordent d'ailleurs avec le contenu de l'idée que nous nous en formons spontanément.Ces éléments sont les suivants: subsistance, unité et totalité, tendance à devenir un système clos, et enfin l'impossibilité d'une définition adéquate. Nous en avons fait la critique dans cet ordre. En suite nous avons proposé les définitions biologiques suivantes : l'individualité consiste en la tendance que possède un organisme naturellement isolé à devenir une totalité subsistante et non-divisée. On aura donc un individu dans la mesure que cette tendance a été réalisée.Enfin, nous avons illustré l'application de cette notion par quelques exemples empruntés au système et à l'ontogénie. In this paper we intend to propose a definition of function in biology. First we delimitated the problem and pointed out that a definition must not be related to hypotheses such as the causal connexion between form and function, phylogenetics or evolution, but that only the existence of functions is to be considered. The elements to be expressed in the definition are: the relation of function to form, the dynamic character, the integration into the activity of the total organism, the (...) possibility of latent functions and the fact that in the case of mechanical functions the function is not itself action, but directly related to it. So we proposed the following definition: A biological function is a property of a definite part of the total organism, marked by a certain form or structure, which property is actual or potential activity itself or directly related to activity, and by which the development and the maintenance of the organism as a whole is enabled to proceed in a harmonious way.We finished with some theoretical remarks in which the logical dependence of the function on the form is brought forward. Therefore form and function are not an example of the principle of complementarity, as is stated byMeyer-Abich. Attention is also given to a former paper byBarge on the form-function problem. This paper served as the starting point for the present discussion.Dans cette étude nous avons l'intention de proposer une définition de fonction en biologie. D'abord nous avons délimité le problème et faisons remarquer qu'une définition ne doit pas être mise en rapport avec des hypothèses comme la relation causale entre forme et fonction, phylogénèses ou évolution, mais que seule l'existence de fonctions doît être considerée. Les éléments qui doivent être exprimés sont: la relation de fonction à la forme, le caractère dynamique, l'intégration dans l'activité de l'organisme total, la possibilité de fonctions latentes et le fait qu'au cas de fonctions méchaniques le fonction même n'est pas action, mais y est immédiatement relative. Ainsi nous proposons la définition suivante: Une fonction biologique est une propriété d'une partie définie de l'organisme total, marquée par une certaine forme ou structure, laquelle propriété est activité actuelle ou potentielle elle-même, ou bien directement relative à l'activité et par laquelle le développement et le maintien de l'organisme total est mis à même d'avancer harmonieusement.Nous avons fini en faisant quelques remarques théoriques, où nous avons exposé que la fonction dépend logiquement de la forme. C'est pourquoi forme et fonction ne sont pas un exemple du principe de complémentement comme cela a été prétendu parMeyer-Abich. Nous avons également fait attention à une étude antérieure deBarge touchant le problème forme-fonction. Cette étude a servi comme point de départ à la discussion présente.Wir haben in dieser Abhandlung versucht eine Definition der “biologischen Funktion” zu geben. Zunächst beschränkten wir uns darauf, darzulegen, dass man bei einer Definition nicht auf Hypothesen hinweisen soll, wie z.B. auf den Kausalzusammenhang zwischen Form und Funktion, Phylogenese oder Evolution. Es soll lediglich des Bestehen von Funktionen berücksichtigt werden.Folgende Elemente müssen in der Definition zum Ausdruck kommen: die Beziehung der Funktion zur Form, der dynamische Charakter, die Integrierung in die Aktivität des Organismus als Ganzes, die Möglichkeit latenter Funktionen und die Tatsache, dass die Funktion im Falle einer mechanischen Funktion selbst nicht Aktivität ist, jedoch in direkter Beziehung zu ihr steht.Wir haben daher die folgende Definition vorgeschlagen: Eine biologische Funktion ist die Eigenschaft eines bestimmten Teiles des Organismus als Ganzes der eine bestimmte Form oder Struktur besitzt: diese Eigenschaft ist ihrerseits wirkliche oder mögliche Aktivität oder aber steht in einem direkten Verhältnis zu ihr; sie ermöglicht die harmonische Entwicklung und Erhaltung des Organismus als Ganzes.Zum Abschluss machten wir einige theoretische Bemerkungen in denen wir die logische Abhängigkeit der Funktion von der Form darlegten. Form und Funktion sind demzufolge kein Musterbeispiel für das Komplementaritäts-prinzip so wie es vonMeyer-Abich angeführt wird. Wir haben uns auch mit einer früheren Abhandlung über das Form-Funktion-Problem vonBarge befasst. Sie diente uns als Ausgangspunkt für die gegenwärtige Erörterung. (shrink)

The article examines the new discourse on medical professionalism and responsibility through the prism of conflicts among moral values, especially with regard to truth-telling. The discussion is anchored in the renaissance of English-language writing on medical ethics in the 18th century, which paralleled the rise of humanitarianism and the advent of the word “responsibility”. Following an analysis of the meanings of the value of responsibility in general and in medical practice in particular, it is argued that, similarly to the Aristotelian (...) notion of equity, responsibility of care is a second-order value, which corrects virtues, laws and norms in exceptional circumstances. Virtues and practices of the second order, such as responsibility and deliberation, bear especially on professional doctoring, which includes a commitment to give priority to the good of the patient over one’s own good. It is argued that, in situations of conflict, and particularly conflicts between personal moral identity and the good of patients, the fundamental professional commitment is to critical and rational deliberation and to the cultivation of psycho-moral flexibility. This leads indirectly to moral growth and strengthening of professional character. (shrink)

The article surveys the history of “terror” vis a vis the development of international humanitarian and human rights law. During the French Revolution, the word “terror” was coined to describe a deviation from the laws of war. Justified by a mixture of ideology and necessity. People who resort to terrorism either suspends or rejects the laws of war (jus in bellum) in the name of an alternative and heightened sense of truth. However, the terrorists’ strong sense of probity and mission (...) is also an opening for re-establishing communication, arbitration and mitigation of cruelty and destruction. This paper represents International Humanitarian Law (IHL) as an “abstract Leviathan”, submission to which is the contemporary norm of pacification. From the perspective of radical terrorism, it is tyrannical. From other perspectives, it is open to criticism and change. Most importantly, it is on the side of rational arbitration rather than arbitrary ordeal. Even radical terrorism, which refuses to recognize the legitimacy of the abstract Leviathan, seeks to communicate its radical messages rather than to seek victory my means of physical annihilation of its opponents. Son étude de l’athéisme en suite de ses recherches sur la relation entre nature et surnaturel dans la vie humaine, l’a. conduit notamment à étudier Proud'hon. La recherche des racines de l'athéisme contemporain lui permet d'aboutir à l’exigence de dialogue avec les athées qui peuvent aussi constituer un aiguillon pour la vérité même des croyants. À la clé de ce dialogue, (...) qui connut ses hésitations, il y a la quête d’un humanisme authentique qui ne soit pas contre l’homme, mais pour l’homme, ce que seule, en définitive, peut garantir la foi au Christ. A great part of the works of Henri de Lubac is devoted to the ideas of those who contest Christian faith. His study of atheism that followed his research on the relation of nature and the supernatural in human life, led him especially to the study of Proud’hon. The study of the roots of contemporaneous atheism allowed him to arrive at this need of dialogue with atheists, who could also furnish a prod for truth, even for believers. The key to this dialogue, which had his hesitations, is the search for an authentic humanism that would not be against man, but for man. Ultimately, this alone can be guaranted by the faith in Christ. (shrink)

Le present volume analyse, non plus en amont la definition kantienne de la science, du savoir, de la scientificite en general, mais cette fois en aval la place des divers savoirs dont Kant a pu traiter. Par une serie d'etudes consacrees a diverses sciences en contexte kantien, le present volume etudie comment Kant assigne a chaque science une unite ideale, une region ontique (un domaine d'objets), une methode, voire une epistemologie, ainsi qu'un mode historique de constitution et de progression propres, (...) avec le constant souci (issu du criticisme) de distinguer les sciences, de ne jamais confondre leurs limites. Ce volume revele ainsi un Kant, non pas seulement theoricien de la science, mais theoricien, voire praticien des sciences en leur pluralite. Kant y apparait comme etant lui-meme un Naturforscher, physicien, scientifique, savant dans les sciences de la nature au sens le plus large. Ce volume souligne l'apport de Kant a un grand nombre de sciences de son temps (mathematique, physique, chimie, biologienaissante, geographie physique, cosmologie, astronomie, mais aussi sciences qualifiees aujourd'hui de sciences de l'esprit ou de l'homme, comme anthropologie ou psychologie), comme en attestent les nombreux opuscules scientifiques que Kant consacre, de 1754 a 1794, a divers sujets de science physique ou d'histoire naturelle (seismes, volcans, marees, climats, vents, influence de la Lune sur la Terre, modification de la vitesse de rotation axiale de la Terre, meteores, cometes, etc.). This paper explores the value of respect for personal autonomy in relation to clearly immoral and irrational acts committed freely and intentionally by competent people. Following Berlin's distinction between two kinds of liberty and Darwall's two kinds of respect, it is argued that coercive suppression of nonautonomous, irrational, and self-harming acts of competent persons is offensive to their human dignity, but not disrespectful of personal autonomy. Irrational and immoral choices made by competent people may claim only the negative liberty to (...) be left alone. Lives disposed to autonomy are worthy of solidarity and active support in addition to the right of free choice and action. Autonomous premeditated desires (distinguished from mere consent) may embody transcendental choices, which transcend consideration of physical and psychological well-being. Choices made by incompetent persons (e.g., children and the mentally disabled) are not related to autonomy, but to self-directedness. The value of human dignity confers protection to self-directedness, but not at the expense of other vital interests. (shrink)

:This article examines the concept of moral enhancement from two different perspectives. The first is a bottom-up approach, which aims at identifying fundamental moral traits and subcapacities as targets for enhancement. The second perspective, a top-down approach, is holistic and in line with virtue ethics. Both perspectives lead to the observation that alterations of material and social conditions are the most reliable means to improve prosocial behavior overall.Moral enhancement as a preventive measure invokes Gnostic narratives on the allegedly fallen status (...) of human nature, its search for salvation, and the dependence of the laity on heteronomous salvific interventions. The allure of the preventive kind of enhancement is attributable to its religious hues.Owing to the absence of clarity regarding moral enhancement and of metrics to evaluate its progress, humanity is at risk of prioritizing unclear and unsubstantiated measures of preventive diminishment at the expense of celebrating human capacities and joys. Ce texte présente le contexte politico-symbolique qui a imprégné la jeunesse de l’auteur au Liban et qui a vu naître sa passion des mathématiques. Il décrit la révolution de ses modes de représentations provoquée par l’éclatement de la guerre civile libanaise, et cela, au contact du milieu intellectuel et politique français. Cela donna corps à son engagement dans un domaine particulier des mathématiques, la « théorie des jeux ». Il introduit brièvement le cadre conceptuel de cette théorie en vue de (...) l’analyse du conflit, et la façon dont il fut étendu pour y inclure les configurations politiques instables. Il livre enfin des lignes directrices pour une modélisation applicable à la condition particulière du Liban et à la récurrence de ses crises structurelles. (shrink)

In the first part of this article we survey the concept of human rights from a philosophical perspective and especially in relation to the “right to healthcare”. It is argued that regardless of meta-ethical debates on the nature of rights, the ethos and language of moral deliberation associated with human rights is indispensable to any ethics that places the victim and the sufferer in its centre. In the second part we discuss the rise of the “right to privacy”, particularly in (...) the USA, as an attempt to make the element of personal free will dominate over the element of basic human interest within the structure of rights and when different rights seem to conflict. We conclude by discussing the relationship of human rights with moral values beyond the realm of rights, mainly human dignity, free will, human rationality and response to basic human needs. In dieser Arbeit werden drei Gedankenexperimente geprüft, die im Diskurs zur Moralität der Abtreibung vorgebracht wurden: der Geiger von Judith J. Thomson und zwei Erwiderungen darauf von Kenneth Himma und Christopher H. Conn. Sie sind dadurch charakterisiert, dass sie von Rechten sprechen, eine besondere Betonung auf Verkörperung legen und an die moralische Intuition appellieren. Ich behaupte, dass nur menschliche Individuen Menschenrechte haben können und dass Individuation nicht auf der Verletzung der moralischen Rechte anderer basieren kann. Deshalb kann der Fetus weder (...) Träger von moralischen Rechten noch ein Aggressor gegen die Rechte seiner Mutter sein. Die Paradigmen der Umweltethik scheinen für moralische Überlegungen über Abtreibung besser geeignet zu sein als das Paradigma der Rechte. Im Zentrum der Umweltethik stehen eher Fürsorge und Achtung vor dem Leben als Rechte; sie ist auf Verkörperung und natürliche Prozesse abgestimmt und beruft sich mehr auf Gefühle der Fürsorge und Tugend als auf ein Gerechtigkeitsgefühl. Although both codes of practice and virtue ethics are integral to the ethos and history of “medical professionalism”, the two trends appear mutually incompatible. Hence, in the first part of the paper we explore and explicate this apparent conflict and seek a direction for medical education. The theoretical and empirical literature indicates that moral deliberation may transcend the incompatibilities between the formal and the virtuous, may enhance moral and other aspects of personal sensitivity, may help design and improve other parts (...) of the curricula, and may foster self-awareness and clarification of the professional role. Not only are these goals essential for good and conscientious doctoring, but they may also reduce physicians’ “burn-out”. We argue that medical education should focus on the ubiquitous practice of deliberation in contemporary medicine, and especially the practice of moral deliberation. (shrink)

This paper presents and discusses a recent Israeli proposal to legislate on the rights of the dying patient. A gap exists between elitist biases of the committee proposing the law, and popular values and sentiments. The proposed law divides the dying patients into two groups: “those who wish to go on living” and “those who wish to die”. The former will have a right to life prolonging extraordinary care. It is not clear who would foot the bill for this care. (...) Also it is hard to see how this munificence could fail to discriminate against all other patients. Both the secular ethicists and the rabbis involved in drawing up the proposal accepted the assumption that it is good for some terminal patients to die. The rabbis objected, however, to direct and active interventions that shorten life. The solution arrived at was to install timers in the ventilators so as to allow them to expire automatically unless the patient wishes for their resetting. (shrink)

Pour décrire les processus dans lesquels se constituent ces configurations conflictuelles, on fait alors appel à des combinaisons conceptuelles plus ou moins heureuses. Depuis la publication des Dits et écrits, la place de la littérature dans l’oeuvre de Michel Foucault a une position bien assignée dans les recherches académiques, où l’on souligne surtout l’approche nietzschéenne de la lecture qu’a proposé le philosophe. Prenant appui sur des nouvelles publications et sur des manuscrits inédits, notre texte envisage ce thème sous un autre prisme, à partir du structuralisme de l’analyse littéraire et de l’enjeu philosophique de la revue Tel Quel dans son rapport avec le Nouveau (...) Roman. En repérant l’importance du concept de « distance » dans ses écrits sur la littérature, nous discuterons comment plusieurs des notions créées par Foucault se trouvent en dialogue avec cette constellation théorique plus large. Nous y établirons ainsi le rapport entre la structure et l’événement, la paire conceptuelle au centre des débats philosophiques des années 1960, qui nous guidera dans la compréhension des tensions et des adhésions de la méthodologie foucaldienne à l’égard de l’analyse structurale. Recorrendo a novas publicações e aos manuscritos inéditos do Fonds Foucault-BnF, este texto enfocará o tema da literatura sob um outro prisma, à partir do estruturalismo da análise literária e do contexto filosófico da revista Tel Quel em sua relação com o Nouveau Roman. Enfatizando a importância do conceito de “distância” em seus escritos sobre a literatura, discutir-se-á como várias das noções criadas por Foucault se encontram em diálogo com esta constelação teórica mais ampla. A relação entre a estrutura e o acontecimento, enquanto par conceitual que se encontrava no centro dos debates filosóficos nos anos 1960, nos guiará na compreensão das tensões e das adesões da metodologia foucaltiana no que tange à análise estrutural.Palavras-chave: Análise literária. Parental decision making is necessary for contracting medical interventions that require personal risk–benefit evaluation, and for overseeing matters of education. In the nineteenth century, exemptions from obligatory vaccination were granted for religious and conscientious reasons. Then and today, religion and moral values play marginal roles in vaccine hesitancy and denialism. Rather, the key values invoked by vaccine hesitants and denialists are liberty and pluralism. Neither is compatible with limiting adolescents’ choice. Because vaccination does not require assessment of personal medical risks, (...) because it does not need to occur within the sphere of the doctor–patient relationship, and because the risk involved is within the range of their daily activities, adolescents have the right to free access to vaccination without legal requirement of parental involvement. Drawing on the development of Common Law, and on the development of respect for personal conscience in the history of ideas, this paper does not promote an argument that grants public health an overriding moral power. Rather, this paper rejects the presumption that vaccination of adolescents might involve a conflict between parental authority and public health. Free access to vaccination is compatible with the law and ethics of adolescents’ evolving autonomy in relation to healthcare. (shrink)

We have investigated the nonlinear low-frequency microwave absorption of an ensemble of small metallic grains. Earlier Zhou et al. [Phys. Rev. Lett. 77, 1958 (1996)] have proved that linear absorption by such a system is due to a mesoscopic relaxation mechanism for which important contribution is from the grains with small level spacings between the ground state and the first excited state. Here we have shown further that such grains are anomalously sensitive to the field amplitude and the distribution of (...) level spacings. Since such a behavior depends on external magnetic field, we expect the appearance of a giant nonlinear magnetoresistance, as well as a very strong temperature dependence of the nonlinear microwave conductivity. Appearing in the “Cairo Declaration on Human Rights in Islam” as an undefined referent for the limits on freedom of expression in Islam, Shariah is still to be chased as an indefinable referent which restricts freedom of the expression in the Islamic Republic of Iran. Iran’s Press Law as well as Constitution unveil Shariah’s referent to be a person: the Jurist-Ruler around whom a cult of personality is legalized in terms of “Imamate” and around whom all the limits on freedom (...) of expression revolve. Interpretation of Shariah is not a solution but part of the problem in Iran. Such problem can be dealt in terms of three modes of self-expression which were invented by the Iranian Reformists to avoid self-censorship. The notion of master-signifier can be the key to unraveling the problem of self-referentiality in freedom of expression and its Reformist solution in Iran’s legal system. (shrink)
